Common Causes of Pedestrian Accidents in Florida

The number of pedestrian-related accidents in Florida has been steadily increasing for over a decade. With roadways becoming congested as more and more people flock to the sunshine state, tourists and locals alike are taking to the streets by foot rather than vehicle to beat traffic. This increase in foot traffic has caused a steady rise in pedestrian accidents.

The increase in foot traffic isn’t the only thing that influences the amount of pedestrian accidents in Florida. Some other factors that increase the likelihood of pedestrian accidents include:

  • Distracted Driving – Drivers engaging in behaviors that take their attention from the road are at an increased risk of an accident. A distracted driver may not see a hazard or pedestrian until it is too late to stop.
  • Intoxicated Driving – Drivers who operate motor vehicles while under the influence of drugs or alcohol put pedestrians and other drivers at risk. Intoxication affects an individual’s perception and reaction timing, increasing the risk of an accident.
  • Speeding – The faster you go, the harder it becomes to control your vehicle. This includes braking. When you increase your speed, you increase your braking distance. You may not be able to come to a full stop in time should a pedestrian cross the street in front of you.
  • Weather Conditions – Weather is an uncontrollable force of nature that affects our day-to-day lives, even when driving. Poor weather can affect visibility, making it harder to spot hazards or pedestrians on the road.

Damages Awarded in Pedestrian Accident Cases

If you or a loved one was a victim of a pedestrian accident, you may find yourself wondering what damages are awarded in pedestrian accident cases. Recoverable damages in a pedestrian accident case can include expenses such as medical bills, lost wages, pain and suffering, and, when applicable, wrongful death. The damages you are able to recover vary based on the severity of your injuries and your medical bills, your lost wages, and the extent of your pain and suffering. Additionally, due to Florida’s modified comparative fault laws, the amount of compensation you recover can be influenced by the percentage of fault you share in the accident, up to 50% responsibility. If you are found 51% responsible or over, you are barred from seeking compensation.

What to Do After a Pedestrian Accident

In the unfortunate event that you find yourself a victim of a pedestrian accident, knowing what to do can help you protect your rights. Moving to a safe space, contacting authorities, collecting evidence, seeking medical attention, and retaining all documentation related to your case are all important steps to take after your accident. Additionally, you should contact a pedestrian accident attorney as soon as possible to ensure your rights are protected.

Florida has a statute of limitations on filing pedestrian accident claims. Generally, you have two years from the date of your accident to take legal action, however certain circumstances may change this deadline. A pedestrian accident lawyer with Magazine & Light Law Group can advise you on how the statute of limitations relates to your case, and assist you with recovering compensation.
